For the sake of transparency and with respect to the protection of your personal data, OctopusMind shows you how the personal data you may provide us are collected and processed.

Personal data collected

OctopusMind makes sure to only collect and process the data strictly necessary for the proper functioning of our services. The nature of the data collected varies depending on the relationship you establish with OctopusMind, depending on whether you are a visitor to our sites, a customer or a partner.

When you use our services, one or more personal data may be collected: IP address, connection and navigation data, email, civility, first name, name, country, VAT and registration number, telephone numbers, photograph, password, postal address, telephone number, links to social network pages, order history, complaints, incidents, subscription information and correspondence on our site. Some data is collected automatically because of your actions on the site (see the paragraph on the navigation data "cookies").

By using our paid services, you are considered a "professional" within the meaning of French law.

Data collected about customers, partners, resellers and business introducers

As part of the use of our services, OctopusMind is required to collect personal data for the proper functioning of its products.

  • Data concerning your identity: last name, first name, postal address, telephone, etc., necessary for the identification of a customer and the billing of services
  • Email address: customers and / or partners and their collaborators
  • Payment information: tracking the payment of your orders

Data on means of payment

Payment information is managed by partner financial institutions. The credit card numbers may be kept in "intermediate filing" in case of possible dispute of the transaction for a period of 13 months in accordance with Article L133-24 of the French Monetary and Financial Code.

Navigation data

The data collected during your visits on the sites published by OctopusMind as well as on the interfaces of management of the services are intended to be exploited ONLY by OctopusMind. We use cookies and tracking to improve and personalize the site and/or measure the audience. Cookies are files stored on the hard disk of your computer during your browsing on the Internet and especially on the site. A cookie is not used to collect personal data without your knowledge but to record information about your navigation on the site that can be directly used during your visits and subsequent requests on the site. Data collected on customers

The collected data allow us to deliver our services and fulfill our contractual obligations :

  • Transmission of alerts and notifications containing business information
  • Management of interventions and technical support for users, partners and their collaborators
  • Purchase orders, invoices and credit notes
  • Respect of our legal obligations and notably as site editor (LCEN French law)

The refusal of information of certain data may result in the impossibility or restriction of the use of some services.

Data user team

The data collected is processed by OctopusMind employees, in the context of strict procedures of confidentiality and authorization according to the uses :

  • Management of sites published by OctopusMind
  • Administrative and accounting management of customer relations, partners, and business introducers
  • Technical management of services and interventions
  • Technical support management

OctopusMind does not sell your data, and only uses it for the promotion or diffusion of its services.

Data retention

The data retention period is not the same depending on the data collected and the nature and purpose of the recording. Similarly, OctopusMind has to give a specific lifetime to some collected data due to legal requirements.

Customer Account Data, Reseller, Introducer or Partner

  • The data associated with the establishment of your billing customer account will be stored by the OctopusMind services for the duration of the contract and for 10 years after the end of the contract in accordance with French law (article L. 123-22 paragraph 2 of the Fench Commercial Code)
  • The data relating to the establishment of your free customer account will be stored by the OctopusMind services for the maximum duration of 2 years after your last connection
  • Every 12 months, we ask you to consent to the processing of cookies
  • A link to delete your account is included in every email we send

Visitor data

The data collected as part of your connections to the sites published by the company OctopusMind are kept for the maximum duration of 2 years after your last connection.

Information request data

The data collected for the purpose of sending you commercial information about our services are kept until you cancel your registration or within a maximum of 10 years. Data collected for non-commercial purposes is kept for 2 years.

An unsubscribe link is included in every automatic business email we send. You can modify or delete your data at any time by accessing your account, or by contacting us to request the deletion of your personal data from our files.

Data storage

The hosting servers on which OctopusMind processes and stores the databases are secure and exclusively located in France.

OctopusMind is committed to informing you within 72 hours of discovering a leak in your data.

Portability of your personal data

Given the email of the concerned account, we can send you your personal data stored in our databases (customer account and list of your contacts, messages and publications) upon request. Provided that this data has not been deleted yet, a structured file will be sent to you within a month.

Exercising your rights

In accordance with the Data Protection Act and the European General Data Protection Regulation 2016/679 (GDPR), you have the rights of access, rectification and deletion of your personal data, which you can exercise by contacting us via the email contact@OctopusMind.info. Your requests will be processed within 30 days. We may ask you to accompany your application with a photocopy of proof of identity or authority. Automatic processing of information has been declared to the CNIL under number 1574916.

You retain the right to file a complaint for violation of the protection of your data with this supervisory authority.

The data manager

Personal data are collected on our sites by the limited liability company called "OctopusMind", registered at the RCS Nantes under the number 480 280 825, whose registered office is located at 2, place Saint-Pierre in Nantes, France.

Modification of the protection policy

OctopusMind reserves the right to modify this Privacy Policy at any time, especially if the laws and regulations change. Changes will be notified to you via our website or when logging into your account.
